हिमाचल प्रदेश राज्य निर्वाचन आयोग (SEC) ने मॉडल कोड ऑफ कंडक्ट, 2020 के एक महत्वपूर्ण प्रावधान को लागू करते हुए राज्य की सभी पंचायतों और नगर निकायों की संरचना, वर्गीकरण और सीमाओं में किसी भी प्रकार का बदलाव तत्काल प्रभाव से प्रतिबंधित कर दिया है।
यह आदेश अधिसूचना संख्या SEC16-29/2000-I-5164 के माध्यम से जारी किया गया है और इसे शीर्ष प्राथमिकता एवं समयबद्ध चुनावी कार्य के रूप में वर्गीकृत किया गया है। यह कदम उन स्थानीय निकायों के समय पर चुनाव सुनिश्चित करने के उद्देश्य से उठाया गया है जिनका कार्यकाल अगले वर्ष की शुरुआत में समाप्त हो रहा है।
सुप्रीम कोर्ट के आदेश के आधार पर निर्णय SEC का यह निर्णय सुप्रीम कोर्ट के उस आदेश पर आधारित है जो स्टेट ऑफ पंजाब एंड अदर्स बनाम बेंट कुमार एंड अनदर (SLPs No. 22468, 22469 of 2024) मामले में दिया गया था। कोर्ट ने स्पष्ट किया था कि संविधान के अनुच्छेद 243E (1) और 243U (1) के अनुसार, स्थानीय निकायों का चुनावी प्रक्रिया उनके पांच वर्षीय कार्यकाल समाप्त होने से छह महीने पहले शुरू हो जानी चाहिए।आयोग ने अधिसूचना में कहा कि पंचायती राज संस्थाओं (PRIs) के पुनर्गठन के लिए अब 75 दिन से कम समय शेष है, जबकि अधिकांश शहरी निकायों (ULBs) के लिए यह अवधि लगभग 60 दिन है, जो स्थिति की तात्कालिकता को दर्शाता है।आयोग के अनुसार विभिन्न निकायों का कार्यकाल इस प्रकार समाप्त होने जा रहा है।

50 ULBs: 18 जनवरी, 2026
धर्मशाला, पालमपुर, मंडी और सोलन नगर निगम: 13 अप्रैल, 2026
अंब, चिरगाँव, कंडाघाट, नरवा और निर्मंड नगर पंचायत: 16 अप्रैल, 2026
सभी 3,577 ग्राम पंचायतों, 90 पंचायत समितियों, 11 जिला परिषदों और 71 नगर निकायों का परिसीमन पूरा कर अंतिम रूप से अधिसूचित किया जा चुका है। 3,548 ग्राम पंचायतों और 70 ULBs की मतदाता सूचियाँ भी अंतिम रूप से प्रकाशित की जा चुकी हैं, जबकि शेष 29 ग्राम पंचायतों और एक ULB की सूची क्रमशः 1 दिसंबर और 7 दिसंबर, 2025 को अंतिम रूप से प्रकाशित की जाएगी।SEC पहले ही 1 मई, 4 जुलाई और 28 जुलाई, 2025 को राज्य सरकार को सूचित कर चुका है कि एक बार वार्ड परिसीमन अंतिम हो जाने के बाद निकाय सीमाएं स्वतः ही फ्रीज हो जाएंगी।आयोग ने अपने संवैधानिक और वैधानिक अधिकारों का उपयोग करते हुए निर्देश दिया है कि चुनावी प्रक्रिया पूरी होने तक किसी भी पंचायत या नगरपालिका की सीमाओं, वर्गीकरण या संरचना में कोई बदलाव नहीं किया जाएगा।यह आदेश राज्य निर्वाचन आयुक्त अनिल कुमार खाची द्वारा जारी किया गया है। सचिव सुर्जीत सिंह राठौर ने इसे मुख्य सचिव, शहरी विकास एवं पंचायती राज विभाग के प्रधान सचिवों, सभी उपायुक्तों-cum-जिला निर्वाचन अधिकारियों और अन्य संबंधित अधिकारियों को भेज दिया है, ताकि इसका कड़ाई से पालन सुनिश्चित किया जा सके।
